Landlords must provide proper notice, wait for the notice period to expire, file with the court, and obtain a judgment before a lockout can occur. Eviction Process Timeline

  1. Notice Period (Nonpayment)

    3 days

  2. Notice Period (Lease Violation)

    7 days

  3. Landlord Can File

    Landlord may file an eviction lawsuit after the 3-day or 7-day notice expires without cure or payment.

  4. Tenant Answer Deadline

    5 days

  5. Hearing Timeline

    Often 2–4 weeks after filing, depending on court schedule and whether the tenant contests.

  6. Lockout / Physical Eviction

    Only the sheriff may execute the writ of possession; landlord cannot change locks or remove tenant without sheriff.
