The eviction process in New York follows a strict statutory timeline. Landlords must provide proper notice, wait for the notice period to expire, file with the court, and obtain a judgment before a lockout can occur. The timeline below outlines each step in chronological order based on current state law.

Eviction Process Timeline

  1. Notice Period (Nonpayment)

    14 days

  2. Notice Period (Lease Violation)

    10 days

  3. Landlord Can File

    Landlord may file a nonpayment or holdover proceeding after the notice period expires.

  4. Tenant Answer Deadline

    Typically at or before the first court appearance date stated in the petition.

  5. Hearing Timeline

    Often 4–12 weeks or longer in busy courts (especially NYC), depending on backlog and whether the case is contested.

  6. Lockout / Physical Eviction

    Only a marshal, sheriff, or constable may perform the eviction after a warrant of eviction is issued.
